The Importance of a Title Search When Buying a Home

Feb 24, 2016

Finalizing a deal with a proper title searchBuying or selling a home is one of the biggest transactions anybody can make. It is so big that the transaction itself needs to be covered by title insurance so that the buyer can be assured they are getting 100% of the rights to the property with their purchase. Title insurance includes a title search which helps to determine who has the rights to the property.

What’s in a Title Search

The primary focus of a title search is to check the chain of title and the status of real estate taxes or judgments on the property. The chain of title lists the ownership history of the property which includes everybody who has bought and sold the property in question. All the names should be spelled accurately and transaction dates must be accurate in order to prevent the title from being clouded which could pose a problem for the buyer.

A tax and judgement search is also done to make sure there are no unpaid or past due taxes and judgments on the property. If either one is unpaid or past due, then this would allow a government entity or a private company who may have done some work on the property to place a claim on the property. This will allow them to put it up for sale even after the buyer purchased the property.
